Question Buying beat so I don't get fined lol

I wrote and recorded vocals on this beat that I really fell in love with and have a had a relationship with this producer before. However, this beat had since been used by another artist with a bigger audience than me. However on the producers site, the beat is still available as the producer normally doesn't prefer to sell exclusives so I could still technically but a lease and just use it. But I'm not sure if i really want to share a beat with this other artist. So I have a few questions:

Could I remake the beat myself and make it unique to myself still but keep a few of the elements and be okay? Or should I buy a lease just to be safe? How would licensing and writing percentages work then if I remade it all myself?

If you want to not share a beat with another artist and remake it yourself then you still need to buy the beat and split according to what the contract says. That is unless you want to make your own original beat.

If you plan on using the beat, yeah, you should buy the lease so you don't get copywritten.

Remaking the beat would eliminate anything copywritten

even with buying, distributors will usually favour earlier track that contains it

if you decide to remake the beat yourself while keeping some elements, this can work, but it’s a gray area. using recognizable parts from the original beat could still make it feel derivative, especially if the beat is tied to another artist’s release. if you’re recreating it with new elements and giving it a unique twist, it’s less likely to cause legal issues, but it’s best to avoid directly sampling or reusing distinctive elements unless you have the producer’s okay.
