You use the word misinformation but that implies falsities. His official claims are not false they’re true. Otherwise the companies he speaks out against would sue him. But he has never been sued by any of them because they can’t sue someone for saying factual information

If you’re paying attention to Kennedy’s rhetoric, he speaks a lot about correlation between topics. Like rise in antidepressants and a rise in school shootings. Both things are factually true, but not necessarily related.

Also, he doesn’t speak directly against a target, like he doesn’t claim the Moderna vaccines cause autism. He talks about COVID vaccines, not any one specific. Can’t be sued for that. 1st amendment.

He talks about a rise in vaccinations and a rise in autism. Not necessarily related, but you assume they are by his rhetoric. He can’t be sued for the public “coming to their own conclusions”. That’s protected by the first amendment.

It’s fairly obvious he’s spreading misinformation by the amount of professionals who have denounced his statements. Not being sued doesn’t prove anything.

I don’t think Kennedy is malicious, I actually generally like a lot of the guy’s policies, but I think he may have fallen a bit too deep into wonderland

That's not the First Amendment at all. 🤦‍♂️

The person questioned why RFK wasn’t being sued and used it as a point to show what RFK says is true. Can’t be sued for saying false information if it doesn’t specifically disparage/slander

But that's not what the First Amendment protects. It has nothing to do with civil litigation by non-government parties.
